These Terms and Conditions, together with all other documents referred to herein, set out the terms under which goods are sold by Swiss Premium Chocolate Café LLC ("SPC") or its sister company through this website. Please read these Terms and Conditions carefully and ensure that you understand them before ordering any goods from our website.

Our website, http://www.cioccabocca.com, is owned and operated by SPC for its own benefit. SPC is a limited liability company incorporated under the laws of the United Arab Emirates, with commercial license number 697897 and its registered office at PO Box 58307, Dubai, United Arab Emirates.

Eligibility

We aim to make the website and its associated services available to as many as possible. However, we do require that you are at least 18 years of age and able to lawfully:

Make payment through one of our accepted tender types;

Agree to these Terms and Conditions;

Enter into binding orders with us. The website is for your personal or gift use only, and commercial usage is not permitted. We reserve the right to decline orders where we suspect commercial usage.

Access To and Use Of Our Site

General information

Access to our website is free of charge. It is your responsibility to make any and all arrangements necessary to access our website.

Access to our website is provided "as is" and on an "as available" basis. We may alter, suspend, or discontinue our website (or any part of it) at any time and without notice. We will not be liable to you in any way if our website (or any part of it) is unavailable at any time and for any period.

In order to take advantage of the features and services of http://www.cioccabocca.com, you can either utilize the website on a "guest check-out" basis or create an account and register your details with us. It is your ongoing responsibility to make sure that any personal and payment details you provide to us are valid, accurate, and complete. You can update your details by accessing your account details on the page. Please keep your account details and password confidential and secure. Our customer service representatives will never ask you for your password.

We are committed to complying with our Security & Protection policy but are not responsible for any loss suffered through misuse of those details. Please notify us as soon as possible if you believe your account has been compromised. By registering or placing an Order on the website, you warrant that you meet the eligibility criteria described above and that the information you provide is yours and is accurate in all respects. Commercial entities are not eligible to register with us.

Conclusion of Contract

Customers place their orders online. The offer to conclude a sales contract is contained in the binding dispatch of the order after the customer has placed the products in their basket and confirmed their selection by clicking the "confirmation" button. The customer can change the entries at any time until the "confirmation" button is clicked. The contract enters into force when SPC sends the customer an order confirmation by e-mail.

Changes to Orders

Any order placed by a customer is binding on the customer. Once the order has been submitted, the customer can no longer make any changes to it. Any existing right to cancel remains unaffected by this paragraph.

The website may contain or provide information regarding the availability of merchandise. This information can be used to estimate the likelihood that an item will be available immediately upon Order placement. Unfortunately, we cannot guarantee that an item stated to be available will actually be available right away, as inventory can change throughout the day. In rare cases, a product may be available when you place an Order but sold out by the time we process the Order. Should this happen, we will notify you.

Terms of Delivery

3.1 Ordered items are delivered at the customer's expense. The delivery and packaging costs are shown separately on the invoice. For deliveries within UAE, the costs for postage and packaging are detailed during the order process; deliveries outside the UAE are not possible through our shop. Please get in contact withus if you wish to do so.

3.2 Deliveries within the UAE are made in the morning or afternoon or at the delivery time contractually agreed by SPC home delivery service.

3.3 Deliveries are done or organised by SPC.

3.4 SPC shall not be held liable if the goods cannot be delivered or are delivered late either because the customer did not provide the correct delivery address, or the intended recipient was not at home or in the event of unforeseeable problems.

3.5 SPC shall not be held liable for delays in delivery that are no fault of its own, e.g. delays resulting from force majeure, traffic congestion, adverse weather conditions, etc. In cases of this kind, the client shall not be entitled to withdraw from the purchase agreement or to claim compensation for damages.

Prices

4.1 The product prices that are listed on the day on which the customer places the order shall apply. The prices are binding until the order has been confirmed by SPC and for the period stated in the order confirmation. Unless otherwise agreed, all prices are gross prices in AED (including VAT).

4.2 SPC reserves the right to adjust its prices as a consequence of changes to taxes, charges, fees, or dispatch costs.

Payment Terms

5.1 Orders in the online shop are paid by debit or credit card. Payments by credit card are debited immediately on conclusion of the contract.

5.2 The ordered goods will only be shipped after the payment has been received.

5.3 In the event of a delay in payment, SPC reserves the right to withhold further deliveries to the customer and to charge a reminder fee and interest on arrears. A debt collection agency will be commissioned with the collection of the debt.

Goods Inspection / Complaints

6.1 The recipient is obliged to check the goods for completeness and condition immediately upon receipt. Any complaints in relation to quality or completeness must be notified to Confiserie SPC without delay, and in no case later than 12 hours after delivery, or the delivery shall be deemed to have been accepted.

6.2 SPC shall not be held liable for transport damage or any damage caused by improper storage of the goods after acceptance by the customer or his/her agents.

Return, Exchange, and Right to Cancel

7.1. There is no right of return or exchange in respect of goods that have been delivered to the customer in full and undamaged.

7.2. After an unsuccessful delivery attempt by delivery services, food law prohibits products that are returned to SPC from being delivered to the customer again. In such a case, the customer must place a new order which is charged at full price.

7.3. When the customer is the user (that is, a natural person who makes the order for a purpose that is neither for commercial nor for independent professional activity), the customer has a right to cancel according to the provisions of the law.

7.4 Your order is guaranteed to arrive in perfect condition at the specified shipping address provided. If you are not completely satisfied with the quality of your order upon arrival, please contact Customer Care (contact@cioccabocca.com or +971 4 220 07 04) within 24 hours of receipt, with a detailed description and photograph(s) evidencing your dissatisfaction, for assistance with a replacement or exchange.

Due to the perishable nature of our products, all claims submitted without proper support documents will not be eligible for reshipment. SPC reserves the right to limit replacements.

SPC is not responsible for failed deliveries when:

You provide an incorrect or outdated address.

Your recipient is out of town or not available.

You do not provide a corrected/new delivery address within 24 hours of the first delivery attempt.

Shipments that are returned or require rerouting due to incorrect addresses will be subject to additional charges for reshipment and/or relabeling for the carrier.

Data Protection

8.1 The data necessary for processing the transaction is stored and forwarded to the company commissioned with delivery for the purpose of performing the contract. Otherwise, stored data is not passed on to third parties except for credit rating agencies and, where necessary, for debt collection. The data is used for customer relations within SPC within the UAE or abroad.

8.2 SPC may conduct order-related and other correspondence electronically. The customer is expressly advised of the security risks beyond the control of SPC connected with data transfer by e-mail, including the transfer of viruses, damage to and/or loss of data, and unauthorized third-party access. By placing an order and providing an e-mail address, the customer authorizes SPC to send documents and other data electronically and also via unencrypted e-mails.

Intellectual Property

Your use of the CioccaBocca Website and its contents does not grant you any copyright, design, trademark, or other intellectual property rights relating to the Content (graphics, photographs, including all image rights, sounds, music, video, logos, icons audio or text on this Website), including our software, HTML, or other code contained in the Website. All such Content, including third-party trademarks, designs, and related intellectual property rights mentioned or displayed on this Website, is typically protected by national and international intellectual property laws and treaties.

You are permitted to use the content only as expressly authorized by us or the licensor of such Content. Any reproduction or redistribution of the content is prohibited and may result in civil and criminal penalties.
